SMS Terms and Conditions

1. Agreement
By opting in to the Appraisal Mark SMS messaging program (the "Program"), you agree to these Terms and Conditions. If you do not agree to these terms, do not opt in to the Program. These terms apply to all SMS messages sent by Appraisal Mark, LLC ("we," "us," or "the Company") through the Program.
2. Program Description
The Program provides automated SMS notifications to appraisers and affiliated professionals of Appraisal Mark for operational purposes related to real estate appraisal assignments. The Program is not a marketing or promotional messaging service.
Messages sent through the Program include:
- New Appraisal Assignments – Notifications of new inspections to schedule, including property address, client information, and a link to the assignment details.
- Schedule Reminders – Periodic reminders for inspections that have not yet been scheduled.
- On Hold Notices – Alerts when an assigned appraisal has been placed on hold by the client.
- Cancellation Notices – Alerts when an assigned appraisal has been cancelled.
- Revision Requests – Notifications of new revision requests on completed appraisals, including a summary of the revision note.
3. Eligibility
The Program is available only to appraisers and professionals who are actively affiliated with Appraisal Mark. You must be at least 18 years of age and a resident of the United States to participate. You must be the account holder or authorized user of the mobile phone number used to receive messages.
4. Opt-In and Consent
By providing your mobile phone number and opting in, you expressly consent to receive automated SMS messages from Appraisal Mark at the number provided. Consent is not a condition of employment, engagement, or any business relationship with the Company. For full details on how to opt in, please see our SMS Opt-In Policy.
5. Message Frequency
Message frequency varies based on your active appraisal assignments and workload. Messages are sent only during business hours, Monday through Friday, approximately 7:00 AM to 7:00 PM Mountain Standard Time (MST). No automated messages are sent on weekends or holidays. Reminder messages may be sent periodically until the relevant action (such as scheduling an inspection) is completed.
6. Message and Data Rates
Message and data rates may apply depending on your wireless carrier and mobile plan. Appraisal Mark is not responsible for any fees or charges imposed by your wireless carrier in connection with receiving text messages through the Program.
7. Opt-Out
You may opt out of the Program at any time by replying "STOP" to any message, by contacting us at info@appraisalmark.com, or by requesting that your mobile phone number be removed from the messaging system. Once your opt-out request is processed, you will no longer receive automated SMS messages from the Program. Please allow a reasonable processing period for your request to take effect.

9. Privacy
Your privacy is important to us. Information collected through the Program is governed by our SMS Privacy Policy. We do not sell, rent, lease, or share your mobile phone number or opt-in consent with third parties for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
10. Content and Links
SMS messages may contain links to our appraisal management system for viewing assignment details. You may be required to log in to access the linked content. Standard web browsing data usage applies when accessing these links.
11. Supported Carriers
The Program is supported on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Service availability may vary by carrier and geographic location.
12. Disclaimer of Warranties
The Program is provided on an "as is" and "as available" basis. Appraisal Mark makes no warranties, express or implied, regarding the reliability, timeliness, or availability of the SMS messaging service. We are not responsible for delays or failures in message delivery caused by your wireless carrier, device incompatibility, or other factors outside our control.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Appraisal Mark shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to your participation in the Program, including but not limited to damages resulting from delayed, undelivered, or misdirected messages.
14. Modifications
We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated effective date. Your continued participation in the Program after any modifications constitutes your acceptance of the revised terms.
15. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
